الهجرة غير الشرعية بين إستراتيجيات المواجهة وآليات الحماية

Abstract

On the basis of the individuals’ right to relocate that is guaranteed in the international conventions and the national legislations, and based on the right of the state to extend and spread its laws on its territory and to prevent all those whom it does not wish to enter into it. The international, regional and national community focused on the search for fundamental solutions which achieve a balance of the ambition and the interests, while respecting the human rights and freedoms. On this basis, this article attempts to clarify the mechanisms adopted to tackle the illegal immigration, and the effectiveness of these mechanisms in respecting freedoms and human rights, either for Algeria or for its regional vicinities (particularly the euro-Arab vicinity).
