آليـات مكافحـــة الفســاد الإداري فـي قانون الصفقـات العموميـــــــة

Abstract

لقد عد الفساد من القضايا الراهنة التي عملت جميع الدول باختلاف تشريعاتها وأنظمتها على محاربته من خلال جــملة من الاتفاقيـــات والمنظمات الإقليمية والعربية الساعية لتضييق مجاله وإيجاد آليات مشتركة لمكافحته باعتباره ظاهرة عابرة للحدود ،كما لا يفوتنـــــا أن ننـــــوه أن الـمشرع الــجزائـــري جرم ظاهــــــرة الفســـاد وعمــــل على مـــحاربتــه من خلال سنه جــملــــة من القوانين فضلا عن استحداثه لعدة آليات وأجهزة من شأنها الحد من هذه الظاهرة ، وتعتبر الصفقات العمومية العجلة الأساسية لتحريك الاقتصاد الوطني فهي أكثر قناة تتحرك فيها الأمـــــوال العموميـــــة للدولــــة الـــجزائريـــــــــة وبالتـــــــالـي فهي تتعـــــرض لـجملــــــة مـــن الــجرائـــــم المتعلقة بالفساد هذا ما دفع بالمشرع الجزائري إلى إحاطتها بمجموعة من القوانين رغبة منه في حماية المال العام والحد من مختلف الجرائم والتي أفرد لها المشرع الجزائري قانون خاص بها 06-01 المتعلق بالوقاية من الفساد ومكافحته.

The Corruption is one of noun days esxes the all countries are fighting over many agreements and organizations witch seeks to narrow its scops and find common mechanism to combat it as a cross-border phenomenon .it is also worth noting that the Algerian legislator criminalized the phenomenon of corruption and worked to fight it through a number of laws as well as the introduction of several mechanisms that reduce the phenomenon and public transactions are the main wheel to more the national economy is the most channel in which the public finds of the Algerian state thus it is exposed to a number of crimes related to corruption .this prompted the Algerian legislator to give it a set of laws in order to protect public money and reduce the various crimes .the Algerian legislator assigned it own law 06-01 on the prevention and control of corruption.La corruption a été comptée dans les problèmes actuels que tous les pays ont fait conformément à leurs législations et réglementations pour lutter contre celle-ci par le biais d'un certain nombre de conventions et d'organisations régionales et arabes cherchant à en réduire la portée et à trouver des mécanismes communs pour la combattre, en tant que phénomène transfrontalier. Par la promulgation de plusieurs lois et l'introduction de plusieurs mécanismes réduisant ce phénomène, les transactions publiques sont la principale roue motrice pour faire évoluer l'économie nationale est le canal le plus émouvant par lequel la mère Le législateur algérien a été soumis à une série de lois afin de protéger les fonds publics et de réduire les différents crimes, auxquels le législateur algérien a attribué sa propre loi 06-01 sur la prévention et le contrôle de la corruption
