Abstract

تعتبر المؤسسة العمومية الاقتصادية سوناطراك أداة فعالة في تنفيذ مختلف سياسات الدولة فهي رئة حياة الاقتصاد الوطني تقوم بتسيير مشاريعها عن طريق الصفقات العمومية التي تعتبر المجال الخصب لتسريع وتيرة التنمية ومواكبة التغيرات الداخلية والخارجية غير أنها تخضع الى خصوصية إجراءات إبرامها في ظل احترام المبادئ الأساسية للتعاقد من حرية الوصول للطلبات، شفافية الإجراءات والمساواة بين المترشحين حفاظا على المال العام والمصلحة العامةهدا ما نص المشرع في المرسوم الرئاسي 15-247. تطرقنا في هذه الدراسة الى مؤسسة سوناطراك نموذجا كون هاته الأخيرة اعتمدت لتسيير مشاريعها إجراءات خاصة مدونة في تعليمة داخلية مصادق عليها من طرف هيئاتها المختصة، أخذت بعين الاعتبار قانون الصفقات العمومية مرجعا لها في ذلك

Résumé : L’enterprise Economies Publique SONATRACH est un outil actif dans l'exécution des différentes politiques de l'Etat, elle est l'artère de la vie de l'économie national, elle gère ses projets à travers les marchés publics, qui est un terrain fertile pour active la roue du development et suivre le rythme intérieur et les changements extérieurs. Résumé : Sonatrach is considered an effective tool in the implementation of various state policies. It is the lung of the life of the national economy. It runs its projects through public deals, which are the fertile field for accelerating the pace of development and keeping pace with internal and external changes. However, it is subject to the privacy of its conclusion procedures while respecting the basic principles of contract freedom. Access to requests, transparency of procedures and equality between candidates in order to preserve public money and the public interest, this is what the legislator stipulated in Presidential Decree 15-247. In this study, we touched on Sonatrach as a model, since the latter adopted special procedures for the conduct of its projects, written in an internal instruction approved by its competent bodies, taking into account the Public Procurement Law as a reference in this.
