Abstract

وهذا حايعتبر عقد تأمين الاستثمار الأجنبي من العقود المفعلة حديثا في الدول العربية فز لدعم التنمية الاقتصادية من خلال ضمان الاستثمار الأجنبي، وهو من العقود التي تلتزم فيه هيئة المتمثلة في هيئة الضمان بتعويض المستثمر المضمون، متى تحقق خطر غير تجاري مقابل أقساط دورية معلومة، لذلك وجب توفير حماية فعالة للمستثمر الأجنبي من المخاطر التي يتعرض لها مشروعه الاستثماري حيث كرست آليات حماية دولية لضمان هذا الاستثمار سعيا لتحقيق التنمية الاقتصادية، حيث أن ضمان المؤسسة ينصب على الأخطار غير التجارية وأن الاستثمار المضمون يجب أن يكون فيما بين الدول المتعاقدة، كما يترتب عن هذا العقد حقوق والتزامات متبادلة في حق طرفية وفي حالة إخلال أحد الأطراف بالعقد هناك آليات قانونية لتسوية النزاعات القائمة بين الأطراف منها وسائل ودية قائمة على التفاوض والتوفيق ومنها وسائل قضائية قائمة على التحكيم، إضافة إلى مبدأ القانون الواجب التطبيق.
