Abstract: The jurist divides the civil eligibility into two sections :eligibility of obligation and eligibility of performance, but the person may be at the age of majority and have the capacity to act legally however, he/she can not exercise these rights because of the eligibility that may nullify it or reduce it according to the the circumstances . A person can not act legally and seek to create a legal effec, but shall be subject to the procedures of detention in accordance with the conditions specified by law.The penal eligibility relates to acts affecting others in themselves and their property which constitute a crime under the penal code .the legislator had to consolidate the age of legal eligibility
