جرائم تقنية المعلومات في ظل الاتفاقية العربية 2010 وفي التشريع الجزائري

Abstract

الملخص : نعيش اليوم عصراً جديداً من التقدم العلمي والتقني في مجال تكنولوجيا المعلومات والإتصالات، نتج عنه إحداث ثورة تنموية بشرية على جميع المستويات والأصعدة المحلية والعالمية، وأصبحت عملية تبادل المعلومات والمعارف تتم بسهولة ويسر، وعلى جانب آخر فقد خلق هذا التطور التكنولوجي العديد من المخاطر والأضرار لا سيما وضعف الرقابة عليها مما أدى إلى ظهور نوع جديد من الجرائم المتطورة والتي تختلف عن سابقاتها من حيث طريقة وأسلوب ارتكابها وشكل وصفات المجرم وطباعه سميت بجرائم تقنية المعلومات وأصبحت تمثل تهديداً مباشر وواضحا للأمن والإستقرار المحلي والعالمي. وإزاء ذلك سعت العديد من الدول إلى تطوير نظمها التشريعية بما يتوافق مع ظاهرة الإجرام التقني الحديثة.

Résumé Nous vivons de nos jours une nouvelle ère marquée par un progrès scientifique et technique dans les domaines des technologies d’information et de télécommunication, duquel il en résulte une révolution de développement humaines, sur différents niveaux sur le plan local autant qu’international. L’échange d’information et de connaissances est désormais une fortement accessible, par ailleurs, ces développements technologiques ont contribué à la création de nouvelles menaces et risques, notamment avec l’impossibilité de leur contrôle de façon permanente, ainsi, nous constatons de nouvelles pratiques criminelles de pointe très différente de leurs précédentes de part leur manière d’orchestration, et les caractéristiques du criminel. Des pratiques nommées conventionnellement « crimes de techniques d’information », lesquelles menacent directement de plus en plus la sécurité et la stabilité locales au même titre qu’internationale. Et face à cette situation, de nombreux états œuvrent inlassablement dans le but de mettre ces littératures et texte juridique au même diapason avec la criminalité technologique moderne.

Abstract : We are now living in a new era marked by scientific and technical progress in the fields of information and telecommunication technologies, which resulted in a revolution of human development on different levels locally as well as internationally. The exchange of information and knowledge is now highly accessible, moreover, these technological developments have contributed to the creation of new threats and risks, in particular with the impossibility of their permanent control, thus, we are seeing new advanced criminal practices very different from their previous ones in their way of orchestrating, and the characteristics of the criminal. Practices conventionally called "information technology crimes", which increasingly and directly threaten local and international security and stability. Faced with this situation, many states are working tirelessly to bring these laws and legal texts in line with modern technological crime.
