فعالية السياسة الجنائية الحديثة في جرائم الأعمال

Abstract

يعد مجال جرائم الأعمال من أهم المجالات استقطابا لمعالم السياسة الجنائية المعاصرة ، و ذلك نظرا لتفرد الجرائم الاقتصادية والمالية والتجارية بالعديد من الخصائص التي تجعلها تخرج عن المبادئ العامة للقانون الجنائي التقليدي، مما أدى إلى المناداة بضرورة اعتماد عقوبات تتناسب مع الطبيعة المتطورة والتقنية لهذه الجرائم وذلك بإعمال العقوبات المالية بدلا من العقوبات الجسدية، فظلا عن اعتماد نظام المصالحة كبديل عن تطبيق العقوبة الجزائية، لما يتميز به من مرونة في التطبيق والفعالية في مكافحة الإجرام في مجال الأعمال مما يتيح إمكانية فك أزمة العدالة.
