الإفراج المشروط آلية لإعادة إدماج المحبوسين في التشريع الجزائري

Abstract

الملخص : تعتبر عملية إعادة إدماج المحبوسين و تأهيلهم من الأهداف التي يسعى إليها المشرع ، و ذلك لتفادي عودتهم إلى ارتكاب الجريمة ، و لعل السياسة العقابية التي انتهجها في هذا الشأن تتمثل في وضع آليات مختلفة لتسهيل عودة المسجون إلى حضن المجتمع ، و قد شرع في إصلاحات مست عدة جوانب من بينها السياسة العقابية ، و كان من بينها صدور قانون تنظيم السجون و إعادة الإدماج الاجتماعي للمحبوسين ، و أنه من بين هذه الآليات و المناهج هو الإفراج المشروط كطريقة بديلة للحبس ، و سبيلا لإعادة الإدماج ، و هذا من خلال بيان شروط الاستفادة من الإفراج ، و أنه وزع الاختصاص بين قاضي تطبيق العقوبات الذي أسند إليه الفصل في الطلبات بالإفراج المشروط و خص السيد وزير العدل في الفصل بشروط محددة و مدة محددة ، إلى جانب ذلك استحدث لجانا منوط بها قانونا الفصل في طلبات الإفراج المشروط "لجنة تطبيق العقوبات "يرأسها قاضي تطبيق العقوبات و " لجنة تكييف العقوبات " يرأسها السيد وزير العدل ،و أن المشرع وضع إطارا بعد الإفراج عن المحبوسين ، أو ما يسمى بالرعاية اللاحقة من مساعدة المفرج عنه و إزالة العراقيل التي تعيق إعادة اندماجه و أنشأت هيئات منوط بها مرافقته .

Résumé : La réintégration et la réadaptation des détenus est l’un des objectif poursuivis Par le législateur afin d éviter leur retour au crime , sa politique a cet égard consiste développer es divers mécanismes pour facilite le retour du détenu au sein la société des reformes ont été initiées a plusieurs égard , y compris la politique punitive , notamment promulgation de la loi sur la réglementation pénitentiaire et la réinsertion sociale des détenus , et parmi ces mécanicisme et ces approches la liberté conditionnel comme une méthode alternative d' emprisonnement et une voie a la réintégration a travers l’ énonce des conditions pour bénéficier d' une libération conditionnel la compétence a été partagée le ministre de la justice , qui est mandaté pour décider selon des conditions et des durées spécifiques , en outre , des commissions ont été crées charger légalement de juger des demandes de liberté conditionnel
