التجميعات الاقتصادية على ضوء قانون المنافسة

Abstract

الملخص: تهدف هذه الدراسة إلى تسليط الضوء على القواعد التي أقرها المشرع الجزائري لتنظيم عملية التجميع تهدف الاقتصادي بما يتماشى مع متطلبات وأهداف المنافسة الحرة، بموجب الأمر 03-03 المتعلق بالمنافسة، حيث جاءت هذه الأحكام لبيان التجميعات التي تدخل ضمن نطاق رقابة مجلس المنافسة باختلاف أشكالها سواء الاندماج الذي يتم بين المؤسسات المستقلة، أو بممارسة الرقابة من خلال ممارسة الرقابة والنفوذ الأكيد، أو بإنشاء مؤسسة مشتركة، إذا أدت المساس بالمنافسة وتعزيز وضعية الهيمنة في السوق المعني.

Résumé : Cette étude a pour objectif de faire la lumière sur les règles approuvées par le législateur algérien afin de réglementer le processus de consolidation économique conformément aux exigences et aux objectifs de la libre concurrence énoncés dans l'ordonnance sur la concurrence 03-03, à savoir les assemblées relevant du conseil de la concurrence, entre des institutions indépendantes, exerçant un contrôle par le biais d'un contrôle exercé et d'une forte influence, ou en créant une institution commune si la concurrence était préjudiciable et en renforçant le statut d'hégémonie sur le marché.

Summary : This study aims to shed light on the rules approved by the Algerian legislator in order to regulate the process of economic consolidation in accordance with the requirements and objectives of free competition set out in the Ordinance on Competition 03-03, namely the assemblies under the competition council, between independent institutions, exercising control through exercised control and strong influence, or by creating a common institution if the competition was harmful and by strengthening the status of hegemony on the market
