الملحق في الصفقات العمومية

Abstract

الملخص : اعترف المشرع الجزائري للإدارة بسلطة تعديل عقودها الإدارية في إطار مايعرف بالملحق ، وذلك من خلال التنظيم المقرر للصفقات العمومية ولذلك إن موضوع الملحق في الصفقة العمومية يكتسي أهمية بالغة في الواقع العملي حيث انه ونظر لما أثير من فضائح مالية لعدد هام من الجهات الإدارية والتي مرد أكثرها التجاوز الصادر من الإدارة المتعاقدة من جراء استعمالها سلطتها في تعديل صفقاتها بإبرام ملاحق تابعة لها ، استوجب الأمر هنا تدخل المشرع للحد من سلطة الإدارة ، فسلطة الإدارة في تعديل عقودها الإدارية وان كانت سلطة أصلية توجد حتى في حالة سكوت العقد ودفاتر الشروط إلا أنها ليست مطلقة كما يمثل الملحق يمثل أداة ووسيلة من وسائل التسوية لمنازعات الصفقات العمومية .
