Abstract

الملخص: تتناولالدراسةالإجراءاتالمكيفةفيالصفقاتالعموميةحسبالمرسومالرئاسيرقم 247/15 المؤرخفي 16 سبتمبر 2015 المتضمنتنظيمالصفقاتالعموميةوتفويضاتالمرفقالعام،وهيإجراءاتداخليةتعدهاالمصلحـةالمتعاقدةللتكفلبالحاجاتالتيتقلعنالحدودالمنصوصعليهافيالمادة 13 منالمرسومالرئاسي15 / 247 بموجبمقررالإجراءاتالداخليةمعمراعاةمبادئالشفافيةفيالإجراءاتوالمساواةبينالمتعاملينوحرية الوصولللطلباتالعمومية،وهذابتحديدالحاجاتمسبقاقبلالشروعفيأيإجراءوترجمتهافيدفترشروط متوازن،معإشهارملائمواستشارةمتعاملينمؤهلين ، كما تخضع هذه الإجراءات لعدة أنواع من الرقابة ،وهيالرقابةالإداريةالداخليةورقابةالمراقبالماليوالمحاسبالعمومي ، إضافة لرقابة المفتشية العامة بالولاية و المفتشية العامة للمالية و رقابة مجلس المحاسبة.

Résumé : L'étude porte sur les procédures adaptées en matière de passation des marchés publics selon le décret présidentiel n°247/15 du 16 septembre 2015 portant réglementation des marchés publics et des autorisations d'utilité publique, qui sont des procédures internes préparées par leservice contractant pour répondre aux besoins qui tombent en dessous des limites prévues à l'article 13 du décret présidentiel 15 / 247 conformément à la décision sur les procédures internes, en tenant compte des principes de transparence des procédures, d'égalité entre les concessionnaires et de liberté d'accès aux demandes du public, et ce par identifier les besoins en amont avant d'engager toute procédure et les traduire dans un cahier des charges équilibré, avec une publicité appropriée et consulter des concessionnaires qualifiés, et ces procédures sont également soumises à plusieurs types de contrôle, il s'agit du contrôle administratif interne et le contrôle du contrôleur financier et du comptable public, en plus du contrôle de l'Inspection Générale de l'Etat, de l'Inspection Générale des Finances et du contrôle du Conseil de la Comptabilité.

Abstract:The study deals with the adapted procedures in public procurement according to Presidential Decree No. 247/15 of September 16, 2015 containing the regulation of public procurement and public utility authorizations, which are internal procedures prepared by the contracting authority to meet the needs that fall below the limits stipulated in Article 13 of the Presidential Decree 15 / 247 in accordance with the internal procedures decision, taking into account the principles of transparency in procedures, equality between dealers, and freedom of access to public requests, and this is by identifying needs in advance before commencing any procedure and translating them into a balanced book of conditions, with appropriate publicity and consulting qualified dealers, and these procedures are also subject to several types of control, It is the internal administrative control , the control of the financial controller and the public accountant, in addition to the control of the General Inspectorate in the state, the General Inspectorate of Finance and the control of the Accounting Council.
