الحماية الإدارية للملكية الغابية في ظل التشريع الجزائري

Abstract

ملخص : تهدف هذه الدراسة إلى إبراز أهم الإجراءات والتدابير الاحترازية الوقائية التي كرسها المشرع الجزائري ضمن المنظومة القانونية للغابات، لحمايتها من استغلال وتوظيف الموارد الطبيعة بشكل غير ممنهج ودون تخطيط، ولدراسة مدى فاعليتها ونجاعتها في التصدي لهذه الكارثة التي استفحلت كثيرا في السنوات الأخيرة من هذه الألفية، وتسببت بمخاطر عديدة على المجتمع والبيئة هو ما دفع المشرع الجزائري لإحاطة هذه الثروة بحماية قانونية خاصة، سواء بموجب قانون الغابات 84-12 باعتباره التشريع الأساسي الناظم لها أو بموجب قوانين أخرى، لضمان دوام هذه الثروة ما جعل المشرع الجزائري يبدي في الآونة الأخيرة اهتماما كبيرا بحماية الملكية الغابية، بتفعيل آليات وقائية ردعية استباقية لتجنب الحرائق، ولعل أهم وسيلة هي الضبط الإداري كإجراء وقائي قبلي، ورغم كل الجهود المبذولة، إلا أن الواقع مازال يكشف عن ضعف المنظومة القانونية للغابات في مجابهة الحرائق، التي مازالت تلتهم آلاف الهكتارات من الثروة الغابية كل عام.

Abstract : This study aims to highlight the most important preventive and precautionary measures established by the Algerian legislator within the framework of the legal system of forests, to protect them from the exploitation and unsystematic and unplanned use of natural resources, and to study the extent of their effectiveness, as well as the effectiveness of dealing with this catastrophe which has greatly worsened during the last years of this millennium. This has threatened society and the environment, as it is, perhaps, the reasons why the Algerian legislator found himself committed to protect this wealth by putting forward certain legal measures, whether within the framework of Forest Law 84-12 as basic legislation regulating it or within the framework of other laws. These measures aim to ensure the sustainability of this wealth. Recently, the Algerian legislator has shown a great interest in the protection of forest property, by activating proactive preventive deterrent mechanisms to avoid fires; perhaps, the most important measure is the administrative control which is taken as a precautionary measure; despite all the endeavours , the reality still reveals the weakness of the forest legal system to face the fires that still destroys thousands of hectares of forest each year.

Résumé : Cette étude vise à mettre en évidence les mesures de prévention et de précaution les plus importantes établies par le législateur algérien dans le cadre du système juridique des forêts, à les protéger de l'exploitation et de l'emploi non systématiques et non planifiés des ressources naturelles, et à étudier l'étendue de leur efficacité, ainsi que l’ efficacité de faire face à cette catastrophe qui s'est fortement aggravée au cours des dernières années de ce millénaire. Ceci a causé de nombreux dangers pour la société et l'environnement, c'est la raison pour laquelle le législateur algérien s’est trouvé dans l’obligation de protéger cette richesse en avançant des mesures juridiques particulières, que ce soit dans le cadre de la loi forestière 84-12 comme législation de base la réglementant ou dans le cadre de d'autres lois. Ces mesures ont pour o bjectif l’assurance de la pérennité de cette richesse. Le législateur algérien à montrer, ces derniers temps, un grand intérêt pour la protection de la propriété forestière, en activant des mécanismes préventifs de dissuasion volontaristes pour éviter les incendies ; peut-être, le moyen le plus important est le contrôle administratif qui est pris par mesure de précaution, malgré tous les efforts déployés, la réalité révèle encore la faiblesse du système juridique des forêts face aux incendies qui dévorent encore des milliers d'hectares de forêt chaque année.
