Abstract: Being a part of cultural heritage, cultural properties, in addition to its intangible importance in preserving identity and its continuity, is a static wealth that can be used as an important economic resource that cannot be underestimated, especially in the sectors of tourism and traditional industries and crafts. In fact, countries which have realized that recently started to initiate a number of practical steps in order to invest in cultural heritage. In this regard, the first step involved setting a clear legal framework and surrounding it with the necessary substantive and procedural protection accordingly so that it can be invested smoothly and judiciously. This; in fact, what Algeria has tried to do since the enactment of Law 98- 04 related to the protection of cultural heritage. The present paper highlights the success of this endeavor, using both descriptive and analytical, and comparative approaches
