الحماية الجنائية للحـق في الصـورة في التشريع الجزائري

Abstract

ملخص: إن الحق في الصورة و الحياة الخاصة للفرد هي من حقوقه اللصيقة بشخصيته ،التي أقرتها التشريعات العالمية و الدساتير و القوانين الداخلية في ظل عصر التكنولوجيا ، ولهذا ومع ظهور التقنيات الحديثة نتج عنها اٍنتهاكات تمس خصوصيات الشخص بكشف أسرارهم للعلن دون إذنهم و علمهم . مما يستوجب الحماية الجزائية لحق الفرد في صورته و حياته الخاصة و هذا بسن قوانين ردعية لمنع هذا النوع من الاٍعتداءات

Rérsumé : Le droit à l’image est un droit jurisprudentiel qui découle du droit au respect de la vie privée , consacré par les législations internationales ,les constitutions et les règlements intérieurs à l’ére de la technologie modern . Avec l’avènement des technologies modernes ,des atteintes à la vie privée des personnes se sont produites , rendant public leurs informations ou éléments d’intimité de vie privée sans leur consentement , ce qui exige la protection pénale du droit de l’individu à son image et sa vie privée à travers l’élaboration de sanctions dissuasives visant à empécher un tel genre d’atteintes .

Abstract : The right to one's own image is a legal right that derives from the right to privacy, protected by international legislation, constitutions and domestic regulations in the era of modern technology. With the advent of modern technologies, people's privacy has been violated, with their information or private life being made public without their consent. This requires penal protection of the individual's right to his or her picture and private life, with dissuasive penalties designed to prevent such violations.
