Abstract

ملخص: عقد التأمين الرياضي هو آلية قانونية تحدد الشروط المتعلقة بتأمين الأنشطة الرياضية والمشاركين فيها، يتم بين المؤمن المتمثل في شركات التأمين والمؤمن له سواء كان شخصا، نادي أو هيئة رياضية لصالحه أو لمستفيد يعين في العقد، و يحتوي على بيانات إلزامية يحددها القانون، ويشمل تأمين الحوادث الرياضية، تأمين الهياكل الرياضية إضافة للتأمين من المسؤولية المدنية، وهو تأمين ذو طابع خاص يجمع بين التأمين على الأشخاص والتأمين على الأضرار، يرتب هذا العقد جملة من الالتزامات على طرفيه، و قد يفرز نزاعات عند تطبيقه تسوى غالبيتها بالطرق الودية وإلا يتم اللجوء إلى القضاء، فعقد التأمين الرياضي ضمانلجميعالمشاركينفيالنشاطالرياضي

Résumé: Le contrat d’assurance sportive est un mécanisme juridique qui définit les conditions et modalités liées à l’assurance des activités sportives et de leurs participants. Il s’établit entre l’assureur représenté par les compagnies d’assurances et l’assuré, qu’il soit une personne, un club ou une organisation sportive à son profit ou pour un bénéficiaire désigné dans le contrat. Le contrat contient des données obligatoires précisées par la loi, et il comprend l’assurance contre les accidents sportifs, l’assurance des biens et des structures sportives, en plus de l’assurance de responsabilité civile, qui est une assurance d’un caractère particulier qui combine assurance des personnes et assurance des dommages. Au pouvoir judiciaire, le contrat d’assurance sportive garantit toute personne impliqué dans l’activité sportive.

Abstract: The sports insurance contract is a legal mechanism that defines the conditions and details relatedto the insurance of sports activities and their participants. It takes places between the insurer represented by the insurance companies and the insured, weather it is a person a club or a sports organizationfor his benefit or for a beneficiaryappointedin the contract. The contract contains mandatory data specified by the law, and it includes sports property and structures insurance, in addition to civil liability insurance, which is an insurance of a special nature that combines insurance for people and insurance for damages. To the judiciary, the sports insurance contract guarantees everyone involved in the sporting activity.
