Abstract

ملخص: أقر المشرع جملة من التدابير لإبرام الصفقات العمومية في ظل جائحة كورونا ،حيث أصدر المرسوم الرئاسي رقم 20/237 المتعلق بالتدابير الخاصة المكيفة لإجراءات إبرام الصفقات العمومية في إطار الوقاية من إنتشار وباء فيروس كورونا(كوفيد19) ومكافحته، حيث سمح بالشروع في تنفيذ الخدمات قبل إبرام الصفقة، وجعل التراضي البسيط قاعدة لإبرام الصفقة العمومية، ومنح الحق للمتعامل في الحصول على مقابل مالي دون إنتظار صفقة التسوية، وأخضعها لرقابة بغرض حماية المال العام في ظل الوضع الإستثنائي، الذي كان السبب فيه جائحة كورونا (كوفيد19)

Résumé: Le législateur a approuvé un certain nombre des marchés piblics à la lumière de l’épidémie de Corona,Ledécret présidentiel №20/237 a été publié concernant des mesures spéciales adaptées aux procédures de passation des marchés publice dans le cadre de la prévention et de la lutte contre la propagation de l’épidémie de coronavirus (Covid 19). Où il a permis de la mise en œuvre des services avant la conclusion de l’accord,Où il a fait un simple consentement mutuel comme base pour conclure le marché public. Il a également accordé au client le droit d’obtenir une contrepartie financière sans attendre l’accord de règlement,Et il l’soumis à un contrôle afin de protéger l’argent public à la lumière de la situation exceptionnelle causée par la pandémie de Corona,Et il l’a soumis à un contrôle afin de protéger de fonds publics à la lumière de la situation exceptionnelle causée par l’épidémie de Corona(Covid 19)
