Abstract

ملخص أصبح الضمان الاجتماعي يشكل منظومة قانونية و هيكلية قائمة بذاتها ، تحكمها فوانين وأنظمة و آليات خاصة بها ، يعتبر الضمان الاجتماعي نظام تضامني بين الدولة وأفراد المجتمع ذو طابع إلزامي يهدف إلى التحقيق من وطأة الأضرار والمخاطر التي تصيب الفرد العامل أو غير العامل ، فهو بذلك يغطي الضمان الاجتماعي مختلف الأخطار الاجتماعية و على هذا النحو فإن قوانين التأمينات الاجتماعية تتولى تحديد الحقوق والالتزامات الناشئة عن العلاقة التأمينية و عليه استطاعت الجزائر بفضل الترسانة القانونية والتنظيمية أن تأسس نظاما للحماية الاجتماعية تتميز بالتنوع وتستجيب لكل الاحتياجات فئات المجتمع و تحقيق أهداف اجتماعية و اقتصادية كبيرة

RESUME : La sécurité sociale est devenue un système juridique et structurel autonome, régi par des lois, des règlements et des mécanismes qui lui sont propres La sécurité sociale est un système de solidarité entre l'État et les membres de la société à caractère obligatoire qui vise à enquêter sur l'impact des dommages et risques qui affligent l'individu actif ou inactif. Ainsi, il couvre la sécurité sociale. Ainsi, les lois d'assurance sociale définissent les droits et obligations découlant de la relation d'assurance, et en conséquence, l'Algérie a pu, grâce à la arsenal organisationnel, pour établir un système de protection sociale caractérisé par la diversité et répondant à tous les besoins de tous les groupes de la société et atteignant de grands objectifs sociaux et économiques.

ABSTRACT : Social security has become a stand-alone legal and structural system, governed by its own laws, regulations and mechanisms. Social security is considered a solidarity system between the state and members of society with a mandatory nature that aims to investigate the impact of damages and risks that afflict the working or non-working individual. Thus, it covers the social security. In this way, the social insurance laws define the rights and obligations arising from the insurance relationship, and accordingly, Algeria was able, thanks to the legal and organizational arsenal, to establish a system of social protection characterized by diversity and responding to all the needs of all groups of society and achieving great social and economic goals.
