إجراءات التحقيق الأولي في الجرائم الرامية إلى الإفلات من الالتزامات العسكرية

Abstract

ملخص الدراسة: يحمي قانون القضاء العسكري مصلحة خاصة وهي المصلحة العسكرية، يتجلى ذلك في المحافظة على نظام المؤسسة العسكرية وترابط قواتها من أجل تحقيق الأهداف والمهام المنوطة بها، لذلك أفرد لها المشرع الجزائري قانون خاص يجمعها بتجريم جميع الأفعال التي قد تمس بها، إذ أدرج ضمن الباب الثاني من الكتاب الثالث في قانون القضاء العسكري الجرائم ذات الطابع العسكري التي لا نظير لها في القوانين الأخرى، وتعد الجرائم الرامية لإفلات مرتكبها من التزاماته العسكرية من بين هاته الجرائم التي حظيت باهتمام كبير من قبل المشرع والمتمثلة في جريمتي العصيان والفرار بالإضافة إلى جريمة التشويه المتعمد. نظرا لطبيعة هاته الجرائم ولخصوصية النظام العسكري الذي تقتضي فيه الفعالية والسرعة في إجراءات البحث والتحري لفرض النظام داخل المؤسسة العسكرية وضمان هيبتها أوجد المشرع أجهزة عسكرية تختص بالتحقيق فيها دون غيرها من أجهزة الضبط القضائي، تباشر اختصاصها وصلاحياتها العادية والاستثنائية طبقا لقانون الإجراءات الجزائية مع مراعاة ما ورد في قانون القضاء العسكري من أحكام.

Résumé de l'étude : La loi sur la justice militaire protège un intérêt particulier dans l'intérêt militaire, comme en témoigne le maintien du système de l'institution militaire et l'association de ses forces afin d'atteindre ses objectifs et ses tâches. Le législateur algérien a donc consacré une loi spéciale à l'incrimination de tous les actes susceptibles de l'affecter. Dans le titre II du livre III de la loi sur la justice militaire, les crimes à caractère militaire sans précédent sont inclus dans d'autres lois. ainsi que le crime de mutilation intentionnelle. Compte tenu de la nature de ces infractions et de la spécificité du système militaire, qui exige une enquête efficace et rapide et une enquête sur le maintien de l'ordre au sein de l'institution militaire et garantissant son prestige, le législateur a institué des organes militaires compétents pour les enquêter et non autres organes de contrôle judiciaire. Le pouvoir législatif exerce ses pouvoirs normaux et extraordinaires conformément au Code de procédure pénale, en tenant compte des dispositions du Code de justice militaire.
