Abstract

ملخص: يعتبر المجلس الأعلى للقضاء هيئة دستورية مستقلة يهتم بإدارة شؤون القضاة ومسارهم المهني، مما جعله يحتل مكانة مرموقة في النظام القانوني والدساتير العالمية. يسعى المجلس الأعلى للقضاء أيضًا لتحقيق مبدأ استقلالية القضاء، وهو ما تضمنه دستور 2020 ويتم وصفه بأنه ضامن لاستقلالية السلطة القضائية، وهذا يتعارض مع الدساتير السابقة التي جعلت رئيس الجمهورية هو الضامن لاستقلالية القضاء.

Résumé : Le Conseil suprême de la magistrature est un organe constitutionnel indépendant chargé de la gestion des affaires des juges et de leur carrière. Il jouit d'une position prestigieuse dans le système juridique et les constitutions du monde entier. Son rôle principal est de garantir l'indépendance judiciaire conformément à la Constitution de 2020, qui remplace le président de la République en tant que garant de cette indépendance selon les constitutions antérieures.

Abstract: The Supreme Judicial Council is an independent constitutional body that is responsible for managing the affairs of judges and their professional trajectory, which has earned it a prestigious position in the legal system and global constitutions. The Supreme Judicial Council also seeks to achieve the principle of judicial independence, which is ensured by the 2020 Constitution and described as a guarantee of the independence of the judiciary, contradicting previous constitutions that made the President of the Republic the guarantor of judicial independence.
