أثر النَّحو في استنباط الأحكام الفقهيّة في آيات الأحكام _ حروف المعاني أنموذجا _

Abstract

جاء هذا البحث لبيان أهمية علم النّحو وأثره في علم الفقه؛ وبخاصّةً في باب حروف المعاني؛ لِما لها من أثر في استنباط الحكم الفقهي وتوجيهه. وهذا راجع إلى تنوّع معانيها التي تعدُّ من أهمِّ أسباب اختلاف الآراء الفقهية وما يترتب على ذلك من أحكام، واقتصر البحث على نوعين من حروف المعاني، هي: حروف العطف وحروف الجرّ، واختار حرفين أو ثلاثة من كل نوع؛ هي :( "الواو"، "أوْ" في العطف، و"الباء"، "إلى"، "مِن" في الجرّ)، مع ذكر بعض الأحكام الفقهية المُترتبة على معاني هذه الحروف كنماذج تطبيقية.

Cette recherche est venue démontrer l'importance de la grammaire et son impact sur la jurisprudence (Fiqh). Surtout au chapitre des significations des lettres(les lettres de significations) ; en raison de son impact sur l'élaboration et l'orientation des règles jurisprudentielles (Fiqh). Cela est dû à la diversité de ses significations, qui est considérée comme l’une des raisons les plus importantes des différences entre les opinions jurisprudentielles (Fiqh) et les décisions qui en résultent. La recherche s'est limitée à deux types de lettres de sens (significations de ces dernières), à savoir : les conjonctions et les prépositions, deux ou trois lettres de chaque type ont été choisies. Ce sont : ("et", "ou" en conjonction, et "par (avec)", "à", "de" au génitif (préposition)) Mentionnant certaines règles jurisprudentielles (Fiqh) qui résultent du signification de ces lettres comme exemples pratiques. L'approche de l'étude était basée sur la présentation des significations des lettres selon les définitions des grammairiens, puis sur leur analyse à partir de ce que les juristes ont conclu lorsqu'ils ont traité des versets des règles, pour conclure au caractère central du sens grammatical dans la dérivation et l'orientation de la règle jurisprudentielle (fiqh).

This research came to demonstrate the importance of grammar and its impact on jurisprudence(Fiqh). Especially in the chapter of the meanings of letters(the letters of meanings); because of its impact on deriving and guiding jurisprudential(Fiqh) rule.

This is due to the diversity of its meanings، which is considered as one of the most important reasons for the differences in jurisprudential (Fiqh) opinions and the resulting rulings. The research was limited to two types of letters of meaning(meanings of latters)، namely: conjunctions and prepositions، two or three letters of each type were chosen. They are: ("and"، "or" in conjunction، and "by (with)"، "to"، "from" in genitive((preposition)) Mentioning some jurisprudential(Fiqh) rules that are resulting from the meanings of these letters as practical examples.

The study’s approach was based on presenting the meanings of letters according to the grammarians’ definitions، then analyzing them based on what the jurists concluded when they dealt with the verses of the rules، to conclude the centrality of the grammatical meaning in deriving and guiding the jurisprudential (fiqh) rule.
