Abstract: The concept of aggression in the Rome Statute has undergone two phases: the first was during the Conference on establishing the International Criminal Court in 1998- where varied international positions of the inclusion of the crime of aggression within the jurisdiction of the Court. It, therefore, was agreed to postpone the exercise of the court's jurisdiction to consider the crime until the adoption of a rule that characterizes as crime, and its necessary conditions for its existence. Accordingly, this has led to adopting the aforementioned conditions during the second conference in the "Kampala" conference in 2010, where it has been agreed on the definition of the crime, and determined the court's jurisdiction to deal with the crime, but the actual practice it will not be possible until 2017.
