آليات حماية المستثمر الاجنبي في التشريع الجزائري

Abstract

تهدف هذه الدراسة إلى بيان الحماية القانونية التي أقرها المشرع الجزائري لحماية المستثمر الأجنبي وما مدى كفايتها، لأنه على دراية كاملة بأهمية استقطاب الاستثمار الأجنبي لذا فقد سعى ومن خلال مختلف قوانين الاستثمار إلىإقرار جملة من الآليات القانونية المقررة لحمايته والتي تنوعت بين آليات موضوعية وآليات إجرائية;فالآليات الموضوعية تهدف إلى حماية المستثمر الأجنبي من المخاطر غير التجارية وضمانه من الإجراءات الانفرادية , أماالآلياتالإجرائية فقد هدف المشرع من خلالها إلى ضمان اختصاص القضاء الوطني بمنازعات الاستثمار كما انه اقر إمكانية لجوئه للتحكيم وذلك في حالة عدم وجود اتفاق بين المستثمر الأجنبي والدولة المضيفة على اللجوء للقضاء وهذا على اعتبار أن التحكيم هو قضاء خاصThis study aims at clarifying the igal protection approved by the algerian iegislator for brotecting the foreign investor becouse of his awaracting foreign through vaious investestment laws to affirm a set of disigned iegal mechanisms to protect it, objective mechinisms the former aims to protect fortingn investors from non-commercial risk also, it aims to ensure them from single procedures, as for procedural mechanisms the iegislator aims to ensure the specialization of the national judiciary on investment disputes, also it recognized the possibility of resorting to arbitration in case of disagreement between the foreign investor and the fost country to resort to the judiciary by considering the arbitration as a private judiciary.Cette étude vise à libérer la protection juridique approuvée par le législateur algérien pour protéger les investisseurs étrangers et leur adéquation, par ce qu'il est pleinement conscient de l'importance d'attirer les investissements étrangers tant recherché et par diverses lois sur l'investissement à l'adoption d'un certain nombre d'évaluations pour la protection dont ont varié entre des mécanismes objectifs et les mécanismes de mécanismes juridiques de procédure; Mécanismes de fond visant à protéger les investisseurs étrangers contre les risques non commerciaux et la garantie des actions unilatérales et les mécanismes de procédure ont pour objectif de l'Assemblée législative par laquelle pour assurer la compétence des litiges judiciaires nationales investissement comme il a reconnu la possibilité de recourir à l'arbitrage, en l'absence d'un accord entre l'investisseur étranger et l'État hôte en matière d'asile pour éliminer ce au motif que l'arbitrage est une justice spéciale
