الضمانات القانونية للمستثمر الاجنبي في ظل القانون 16-09

Abstract

تعد الضمانات القانونية من أهم الآليات التي وضعها المشرع الجزائري بهدف تشجيع الاستثمار الأجنبي والتي نظمها بموجب قانون الاستثمار 16-09 وهي بعدة أصناف منها ما هو ذو طبيعة موضوعية مثل الضمانات التشريعية لحماية المستثمر الأجنبي من الممارسات السيادية للدولة من خلال تقييدها بعدم التدخل في العقد بإرادتها المنفردة وتقرير الحماية القانونية لملكية المستثمر من المخاطر السياسية التي قد يتعرض لها مشروعه الاستثماري وأخرى ذو طبيعة إجرائية مثل الضمانات القضائية التي تكفل له اللجوء الى التحكيم الدولي كضمانة حمائية لاقتضاء حقه.Il est à concidéré que les garanties juridiques des mécanismes les plus importants mis au point par le législateur algérien afin d'encourager les investissements étrangers, organisée en vertu de la Loi 16-09 d'investissement, un certain nombre de variétés dont est de nature objective, comme des garanties législatives pour la protection des investisseurs étrangers des pratiques souveraines de l'Etat à travers la restriction de la non-ingérence dans le contrat à sa seule discrétion et le rapport de la protection juridique de la propriété de l'investisseur des risques politiques qui pourraient être exposés à son projet d'investissement et l'autre de nature procédurale, telles que les garanties judiciaires pour lui de recourir à l'arbitrage international comme une garantie de protection pour exiger le droit.The legalguarantees of the most important mechanismsdeveloped by the Algerian legislature in order to encourage foreigninvestmentwhichorganizedunder the Investment Law 16-09, several classes of what is substantive in nature, such as legislativeguarantees for the protection of the foreigninvestorfrom the sovereign State through the practices of non-derogablerights not to interfere in the contractunilaterally and the report of the legal protection of the investor'sownership of the politicalrisks that mightbeexposed the investmentproject and other procedural nature, such as the judicialguaranteeswhichensure that recourse to international arbitration as a guarantee of protection to claim hisrights
