مكانة المعارضة البرلمانية في التعديل الدستوري 2016

Abstract

لقد حرص النظام الجزائري على غرار الأنظمة في الدول المتقدمة على تكريس دور المعارضة البرلمانية و رعايتها و تطويرها كونها تشكل دعامة أساسية لحمايته من الإعوجاج و هذا بعد المراجعة الدستورية لعام 2016 حيث نص في المادة 114 منه على مجموعة من المكاسب غير المسبوقة للمعارضة البرلمانية ،وذلك بإحداث حقوق جديدة شكلت قفزة نوعية لإرساء مبادئ الديمقراطية و التعددية الحزبية خاصة داخل قبة البرلمان وذلك بتخصيص جلسة شهرية في كل غرفة من غرفتي البرلمان لمناقشة جدول أعمال تقدمه مجموعة أو مجموعات برلمانية من المعارضة ، ولقد فصل المؤسس الدستوري بين نوعين من الحقوق التي تتمتع بها المعارضة البرلمانية بحيث هناك حقوق تمكنها من المشاركة الفعلية في مجال الأشغال البرلمانية و حقوق أخرى في المجال السياسي، إلا أنها لازالت حبرا على ورق ولا زالت المعارضة البرلمانية بعيدة كل البعد عن ممارسة أدوارها الدستورية الجديدةLe régime algérien a l’inctar des pays dévloppés a veillé de concarer le role de l’opposition parlementaire,il le garde et le dévloppé taut qu’il est le pilier prencipale pour le protéger des dirives et cela après la réforme constitutionel de 2016 au son article 114 stiqule un ensemble des bénéfises jamais obtenu par l’opposition auparavant et cela par l’inctitution des neuveux droit qui à constitué un grand pas pour instaurer les prinsiper de la démocratie et le multipartion spécialement dans le chambre parlementaire et pour consacré une séance monsielle dans chaque chambre dés chambres parlementaire pour débatere l’ordre du jour fermi par l’un au des groupes parlement de l’oppotion .
