أثر القضاء في خصومة التحكيم

Abstract

يبرز تدخل القضاء في خصومة التحكيم من خلال مرحلتين أساسيتين قبل صدور حكم التحكيم يمكن رصد أهمها فيما يلي حالة تعيين المحكم بدلا من الطرف الممتنع عن التعيين ، وحالة رد المحكم ،و حالة المنازعة على إختصاص المحكم و حالة القيام بإتخاذ التدابير المؤقتة أو التحفظية و الحصول على الأدلة . أما الدور الذي يبرز بعد صدور الحكم التحكيمي فهي لاتعني تدخلا في مهمة المحكم ،حيث يمكن حصرها في التالي بمناسبة طلب إعتراف أو التنفيذ وكذا عند الطعن الحكم التحكيم الدولي L'intervention du pouvoir judiciaire se figure dans le différend d'arbitrage par deux étapes principales avant que la décision du jugement soit pris et qu'il peut surveiller les plus importants et que le cas suivant de la nomination de l'arbitre, plutôt que l'abstention partie pour la nomination et l'état du litige dans la compétence de l'arbitre et le cas de prendre des mesures temporaire et de précaution et l'obtention de preuves.
