ضوابط تسليم المجرمين في ظل إتفاقيات التعاون الأمني

Abstract

إن التقدم العلمي ساهم كثيرا في تطور العالم وسهل الكثير من الأمور لاسيما وسائل المواصلات بين الدول وسقوط الحواجز والحدود بينها بما صاحبه ذلك من سهولة تنقل الجناة، لهذا تناولنا في هذا البحث أهم شكل من أشكال التعاون القضائي وهو تسليم المجرمين ، فنظام تسليم المجرمين نقصد به أن تتخلى الدولة على شخص موجود على اقليمها لدولة أخرى بناءا على طلبها لتتولى محاكمته عن جرائم منسوبة إليه أو تنفيذا لحكم صادر من محاكمها، والغرض من التسليم هو عدم فرار المجرمين من العقاب، كما أن نظام التسليم هو خير مظاهر تضامن الدول في مجال مكافحة الجريمة الدولية.Le progrès scientifique a contribué grandement au développement du monde et facile beaucoup de choses, notamment des moyens de transport entre les États et la disparition des barrières et des frontières entre eux, y compris la facilité de mouvement des criminels, ce que nous avons rencontrés dans cette recherche est la forme la plus importante de la coopération judiciaire est l'extradition, nous entendons que l'état à renoncer d'une personne présente sur sa territoire à un autre État fondé sur la demande de prendre son procès pour des crimes qui lui sont attribués ou l'exécution d'une sentence prononcée par ces tribunaux, et le but de l'extradition de prévenir l'évasion des criminels de la peine, c'est aussi la meilleure apparence de la solidarité des nations dans la lutte contre la criminalité internationale.The scientific progress has contributed greatly to the development of the world and facilitated many things, especially the means of transportation between countries and the fall of barriers and borders with the ease of the escape of offenders, so we discussed in this research the most important form of judicial cooperation which is extradition, the extradition system is intended that a State renounce a person on its territory to another State at its request to be tried for crimes attributed to him or for the execution of a judgment issued by her courts. The purpose of extradition is to prevent criminals to escape punishment; it is also one of the best appearances of States solidarity in the fight against international crime.
