مسؤولية مؤدي خدمات التصديق الإلكتروني

Abstract

إن وجود طرف ثالث في العلاقة التعاقدية عبر وسائل الإتصال الحديثة و الذي أطلق عليه المشرع الجزائري تسمية مؤدي خدمات التصديق الإلكتروني وفقا لقانون 15-04 عنصر جوهري لضمان الأمان و الثقة لدي مستخدمي وسائل و تقنيات الإتصال الحديثة و وسيلة من الوسائل التي تكفل تحديد هوية المتعاقدين والتعبير عن إرادتهم علي نحو صحيح، وبطريقة يمكن معها نسبة التصرف إلي صاحبه حيث تقوم هاته الجهات بتوثيق المعاملات الإلكترونية، و تقوم بمنح شهادات التصديق الإلكترونية لإثبات التصرف عبر الإنترنت وهاته الجهات لا يمنح لهم التراخيص لممارسة نشاط مؤدي خدمات التصديق الإلكتروني إلا وفق شروطا معينة و محددة قانونا ، فإذا توفرت هذه الشروط تمنح لهم السلطة المختصة الترخيص لممارسة مهامها فتترتب عليهم إلتزامات ومن هنا تأتي مسؤولية مؤدي خدمات التصديق الإلكتروني.لأنه في حالة ما إذا أخل مؤدي خدمات التصديق الإلكتروني بهذه الإلتزامات الملقاة علي عاتقهم تترتب عليهم مسؤولية وينتج عن هذه المسؤولية تعويض المتضرر عما لحقه من ضرر. .
