مبدأ حرية الاستثمار والتجارة في الجزائر

Abstract

لكل شخص الحرية في ممارسة الاستثمار والتجارة، أو مزاولة أي نشاط اقتصادي آخر، وهذا ما يجسد في مضمونه مبدأ حرية الاستثمار والتجارة، والذي يعد من أهم مبادئ الديمقراطية والحريات التي نصت عليها المواثيق والمعاهدات الدولية، والمكرسة في أغلب القوانين الجزائرية والتي يأتي على رأسها القانون الأسمى في الدولة ألا وهو الدستور. إلا أنه يلاحظ أن حرية المبادرة الخاصة الاقتصادية بصفة عامة ومبدأ حرية الاستثمار والتجارة بصفة خاصة وكنتيجة منطقية يخضع لجملة من القيود والاستثناءات القانونية، مما يفهم منه أن كل من الحرية والقيود كلاهما مقيد.Toute personne a le droit d'exercer l'investissement et le commerce, ou n’importequelle autre activité économique, ceci incarne le contenu du principe de la liberté de l'investissement et du commerce, qui est l'un des principes les plus importants de la démocratie et des libertés énoncés dans les conventions et traités internationaux, et inscrit dans la plupart des lois algériennes, dont le plus important est la loi suprême dans l'état, à savoir la Constitution. Toutefois, il note que la liberté d'initiative économique privée en général et le principe de la liberté de l'investissement et du commerce en particulier, à la suite d'une logique est soumise à un certain nombre de restrictions et exceptionslégales, ce qui signifie que la liberté et les restrictions sont à la fois limitées.Everyone has the right to exercise investment and trade, or to engage in any other economic activity.
