ضمانت المحاكمة العادلة في التشريع الجزائري

Abstract

يقصد بحقوق الإنسان جملة الحقوق اللصيقة بالشخص الإنساني و التي نصت عليها المواثيق الدولية و التي يتمتع بها الإنسان ولا يجوز بأي حال تجريده منها لأي سبب كان و بصرف النظر عن جميع مظاهر الاختلاف سواء في الدين أو اللغة أو العرف أو الجنس. حيث يجب حماية هذه الحقوق لضمان محاكمة عادلة . و لقد عرفت المحاكمة العادلة بأنها أحد الحقوق الأساسية للإنسان و تقوم على توافر مجموعة من الإجراءات التي تتم بها الخصومة الجنائية في إطار حماية الحريات الشخصية ،سارعت معظم الدول إلى تكريس هذا المبدأ في نظمها القانونية بغية ضمان المحاكمة العادلة للمتهم لكونه إنسان. و الجزائر من بين هذه الدول التي حاولت تكريس هذه المبادئ و أوجدت ضمانات لذلك.لاسيما الضمانات الدستورية و الضمانات التشريعية للمحاكمة العادلة.Signifie que les droits inhérents clause des droits de l'homme de la personne humaine et prévues par les conventions internationales et dont jouit l'homme, ni en aucun cas être dépouillé d'entre eux pour une raison quelconque et peut le distingue de tous les aspects de la différence, que ce soit dans la religion, la langue, la coutume ou le sexe. Et un procès équitable a été reconnu comme l'un des droits fondamentaux de l'être humain et est basé sur la disponibilité d'une gamme de procédures pénales qui sont contradictoires dans le cadre de la protection des libertés individuelles, la plupart des Etats se sont empressés de consacrer ce principe dans leurs systèmes juridiques afin d'assurer un procès équitable de l'accusé d'être un être humain.
