الرقابة الإدارية على الصناعة الغذائية

Abstract

تهدف هذه الدراسة إلى تحديد الأجهزة الإدارية المكلفة بعملية الرقابة على الصناعة الغذائية، و ما هي مختلف الآليات القانونية و التقنية المستعملة لبلوغ الأهداف المرجوة من هذه الرقابة، فالصناعة بعد أن انتقلت من احتكار القطاع العام إلى المنافسة الحرة ، و الرغبة الشديدة لدى المتعاملين الاقتصاديين الخواص في تحقيق الربح السريع بالطرق المشروعة والغير مشروعة الوضع الذي يفرض على الدولة التدخل لحماية المستثمرين فيما بينهم و حماية عموم المستهلكين من الممارسات الغير مشروعة للمتدخل كما أن هذه الرقابة تظهر أهميتها من خلال حماية الاقتصاد الوطني بضمان جودة المنتجات الغذائية المصنعة وبالتالي تحقيق قدرة تنافسية لها.. فمن الواضح أن هذا النوع من الرقابة موزع على عدة أجهزة منها ما هو تابع للإدارة المركزية ممثلة في وزارة التجارة و مختلف المصالح الخارجية التابعة و منها ما هو تابع لهيئات إدارية عامة متخصصة أسندت لها مهام هذه الرقابة، ممثلة في الخصوص في المركز الجزائري لمراقبة النوعية و الرزم اللجنة الوطنية للمدونة الغذائية، المجلس الوطني لحماية المستهلك، مجلس المنافسة. Cette étude vise a préciser les dispositifs administratifs chargés du control sur l’industrie agroalimentaire, et les différents mécanismes légaux , utilises pour réaliser les objectifs prévus de ce control .L’industrie après être transférer de monopole du secteur public a la concurrence libre, et la volonté auprès des operateurs économiques dans la réalisation d’un bénéfices rapides par des façons légitimes Qui obligent l’Etat a intervenir pour protéger les investisseurs entre eux et de protéger les consommateurs en général des pratiques illicites de l’intervenant et que ces contrôles montrent leur importance en protégeant l’ économie et assurant la qualité nationale des produits alimentaires et donc atteindre son concurrentiel . Il est clair que ce genre de contrôle repartie sur plusieurs dispositifs, y compris ce qui est lie a l’administration centrale , représentée par le ministère du Commerce et de divers services étrangers filiales et dont certains se lies a des organismes spécialisé administrative générale lui attribuer cette fonction de surveillance, représentée en particulier dans les centres algériens de contrôle de la qualité et le comite national pour la nourriture, le conseil national pour la protection des consommateurs , le conseil de la concurrence.
