حق المستهلك في العدول

Abstract

نخلص إلى أن خيار العدول في التعاقد بمعناه الدقيق في إطار هذه الدراسة يجد مجاله في المرحلة التي تلي إبرام العقد, ويعرف بعض الفقه حق العدول بأنه أمر عارض محقق الوقوع يرد على العقود اللازمة فيفقدها اللزوم أثناء مدة الخيار به يستطيع أحد المتعاقدين أو كلاهما فسخ العقد, أو إجازته بإرادة منفردة ويشمل حق العدول بعض أنواع العقود, ففي القانون الجزائري أقر المرسوم التنفيذي رقم 15-114 المتعلق بشروط و كيفيات العروض في مجال القرض الاستهلاكي نوعين من العقود على وجه الخصوص عقد البيع بالمنزل والقرض الاستهلاكي, ويكون هذا الحق محدد بمهلة قانونية, وينتهي الحق في الرجوع باستعماله, أو بفوات المدة المحددة, أو بالنزول عنه, ويترتب عن هذا الحق أيضا أثار تسري على المستهلك والمهني على حد سواء.Le choix de la rétractation dans les contrats dans cette étude trouve son domaine d"application dans la période qui suit la conclusion du contrat .
