العلاقـــــــــــة بين الحاكـــــــم والمحكـــــــوم عند « أبي الحسن المــــــاوردي »

Abstract

بین دفتي هذه المذكرة فصول ومباحث في الفكر السیاسي الإسلامي الكلاسيكي، وقد اخترت أبو الحسن الماوردي كنموذج لهذه الدراسة حیث حاولت مُعالجة إشكالیة العلاقة بين الحاكم و المحكوم في تصوره ، فالماوردي عايش فترة سياسية مليئة بالصراعات الداخلية حول نظام الحكم ، كما عرف عهده تمزق الدول الإسلامية ومذاهبها، و هذا الواقع السياسي كان له أثر على نظرة الفقهاء في الحكم و السلطة وأحكامها الشرعية في ظل المستجدات التي طرأت على الدولة الإسلامية، حاول الماوردي الوصول إلى حل فقهي يتلاءم مع الواقع وفي نفس الوقت لا يتناقض مع الشريعة الإسلامية، فأراد الماوردي مقاربة واقعه السياسي المشحون بالطائفية إلى وضع نظرية سياسية تتأسس على الخلافة السنية التي يعتبرها كاملة الشرعية .

Between the covers of this dissertation there are chapters and fields of discussion on the Classical Islamic Political Thought. Abu al-Hasan Al-Mawardi was chosen as a study case, where I tried to address the problematic the relationship between governor and people according to Abu al-Hasan Al-Mawardi. He cohabited political period filled with internal conflicts about governance. As it is known his era faced a rupture in the Islamic counties and its doctrines. This political reality has had an effect on the fuqaha ' point of view concerning the authority and legal provisions, Al-Mawardi attempted to reach doctrinal solution adapted to reality and at the same time does not contradict Islamic law, Al-Mawardi wanted to approach his political reality with sectarian-ridden to make political theory based on the Sunni Caliphate deemed full legitimacy.
