الرشوة في القطاع الخاص

Abstract

يتناول هذا البحث ظاهرة الرشوة في صورة من صورها المستحدثة وهي جريمة الرشوة في القطاع الخاص، وهي من الموضوعات الهامة ذات طابع إجتماعي إقتصادي، وقد تصدى لها المشرع الجزائري من خلال الإستراتيجية التي تبناها في ظل قانون 06-01 المؤرخ في 20 فيفري 2006 المتعلق بالوقاية من الفساد ومكافحته، وهذا القانون جاء في شقين الشق الأول يتعلق بالوقاية من الفساد من خلال الآليات الوقائية، وهي عبارة عن جملة من التدابير الوقائية وكذلك الاليات المؤسساتية (الهيئة الوطنية للوقاية من الفساد ومكافحته والديوان الوطني لقمع الفساد)، ودور المجتمع المدني في التصدي لهذه الظاهرة، أما الشق الثاني فيتعلق بآليات مكافحة الفساد وتمثلت في إجراءات المتابعة الجزائية والعقوبات المقررة لمرتكبي جريمة الرشوة في القطاع الخاص. وهنا فإن المشرع الجزائري ومن خلال السياسة الجنائية التي اتبعها فيما يتعلق بالوقاية من الفساد ومكافحته ، فقد ساير ما أقرته الإتفاقيات الدولية والإقليمية وخاصة إتفاقية هيئة الأمم المتحددة الصادرة في 31 أكتوبر 2003 .

Our research theme addresses the phenomenon of corruption in the form of the newly created crime of corruption in the private sector, It is an important socio-economic issue that has been addressed by the Algerian legislator through the strategy adopted by law N 06-01 of 20 February 2006 on the prevention and fight against corruption. This law is divided into two parts: the first part concerns the prevention of corruption through preventive mechanisms that corresponds to a series of preventive measures as well as the institutional mechanisms (National Commission for the prevention and fight against corruption and the Central Office for the Repression of Corruption) and the role of civil society in this phenomenon. The second part deals with anti-corruption mechanisms, criminal monitoring procedures and sanctions for private sector bribery offenders. The Algerian legislator, through its criminal policy on prevention and the fight against corruption, has adopted international and regional conventions, in particular the United Nations Convention of 31 October 2003.

Notre thème de recherche traite le phénomène de la corruption sous la forme du crime de corruption nouvellement créé dans le secteur privé, C'est une question socio-économique importante qui a été traitée par le législateur algérien à travers la stratégie adoptée par la loi N° 06-01 du 20 février 2006 relative à la prévention et la lutte contre la corruption. Cette loi est scindée en deux parties : la première partie concerne la prévention de la corruption par le biais de mécanismes préventifs qui correspond à une série de mesures préventives ainsi que les mécanismes institutionnels (commission nationale chargé de la prévention et la lutte contre la corruption et l'office central de répression de la corruption) ainsi que le rôle de la société civile face à ce phénomène. La deuxième partie, concerne les mécanismes de lutte contre la corruption, les procédures de suivi pénal et les sanctions applicables aux auteurs d'infractions de corruption dans le secteur privé. Le législateur algérien, à travers sa politique pénale en matière de prévention et la lutte contre la corruption, a adopté les conventions internationales et régionales, en particulier la convention des Nations unies du 31 octobre 2003.
