Abstract: Author's rights are considered one of the most important intellectual property rights because they represent intellectual and mental creativity. Moral rights take a substantial part of them, because they protect the creator from any infringement that could affect his literary novelty. Algerian legislation followed this by creating law 03-05 which regulated these rights and endorsed a certain number of preventive measures and civil liability in case of violation of these rights. It added criminal liability. The law adopted the majority of the rules approved by international conventions which protect the rights of authors in general.
