Abstract

تهدف هذه الدراسة إلى توضيح النموذج القانوني لجريمة تهريب المهاجرين، من منظور البروتوكول المتعلق بمكافحة تهريب المهاجرين عن طريق البر والبحر والجو المكمل لاتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية، والقانون رقم 09-01 المعدل والمتمم لقانون العقوبات، وذلك بهدف الوقوف على مواطن الاتفاق والاختلاف بينهما.بحيث سمحت لنا الدراسة من تحديد صفة الجاني في جريمة تهريب المهاجرين وطبيعة السلوك المجرم، والعقوبات المقررة له مع تبيان ظروفها المشددة والمخففة.
