النظام القانوني لحوكمة الهيئات الرياضية

Abstract

الملخص من أجل النهوض بهيئتنا الرياضية لابد من تفعيل مبادئ الحوكمة المرتبطة بتسيير هذه المؤسسات الرياضية والتحكم فيها باستعمال معايير تنظيم العمل وممارسات الأطراف وأصحاب المصالح والعلاقات فيما بينها سواء كانت هذه شركات الأنشطة الرياضية وتتمثل عادة في اللجان الأولمبية أو الوطنية والأندية الرياضية بما يوافق خاصة قانون الجمعيات 12/06 وقانون الرياضة 13/05 وغيره من القوانين الأخرى. تعتبر أهم الأعمال التي تقوم بها هذه الهيئات الرياضية والتي تستدعي تطبيق هذه المبادئ عليها هي تسيير المنافسات الرياضية نظام التحفيز في الهيئات الرقابية وهذا يخص الأعمال الداخلية لهذه الهيئات أما الأعمالالخارجية فتتمثل في كيفية تمويل هذه الهيئات أو التسويق مكتسباتها مع مراعات أساسيات التأمين والسلامة وتعزيز دور الرقابة الخارجية بما يحافظ على النظام العام لهذه الهيئات.

Résume : Afin de faire progresser notre instance sportive, il est nécessaire d'activer les principes de gouvernance liés au fonctionnement de ces institutions sportives et de les contrôler en utilisant les normes d'organisation du travail et les pratiques des parties et des parties prenantes et les relations entre elles, que ces entreprises soient des activités sportives et soient généralement représentées dans les comités olympiques ou nationaux et les clubs sportifs conformément notamment à la loi sur les associations 12 / 06 et la loi sur le sport 5/13 et d'autres lois. Le travail le plus important réalisé par ces organismes sportifs qui exigent l'application de ces principes à eux est la conduite de compétitions sportives, le système de motivation dans les organismes de régulation, et cela concerne le travail interne de ces organismes. Quant au travail externe, c'est comment ces organismes financent ou commercialisent leurs gains en tenant compte des fondamentaux de l'assurance et de la sécurité et en renforçant le rôle du contrôle externe Ce qui maintient l'ordre général de ces organes.
