Abstract: This research deals with the study and analysis of two important international crimes, namely genocide and war crimes, as we aim to clarify and clarify the international legal nature of each of them by defining what they are. While war crimes occur when a country violates the rules, laws and customs of war internationally recognized and codified in the relevant international agreements. This study revolves around researching the general legal theory of the crime of genocide and war crimes by addressing the concepts defined for them at the international legal level through the conventions regulating the two crimes, then the constituents of them, and the standards that distinguish them from each other, in order to remove any overlap or ambiguity They may revolt around them, by relying on the legal methodology based on the descriptive and analytical approaches in order to reach legal objective results
