الجريمة المنظمة في التشريع الجزائري

Abstract

المخلص: من أبرز التحولات التي طرأت على طابع الجريمة هو ظاهرة الإجرام المنظم والتي باتت تهدد كيان الدولة على الصعيدين الداخلي والخارجي وعليه كان لابد من استحداث إجراءات جديدة لمحاربة هذه الظاهرة من إتفاقيات ومواثيق دولية سيما القانون الوطني للدولة لمواكبة التطور الدولي، مما أدى بالمشرع الجزائري إلي استحداث وسن قوانين جديدة سعيا منه إلى مواكبة ظاهرة الجريمة المنظمة ، حيث استحدث المشرع الجزائري فعالية جديدة لقانون الإجراءات الجزائية سيما قانون 07_17والذي تضمن التوسيع من مهام وصلاحيات الشرطة القضائية كل ذلك لتسليط الضوء على مدى نجاعة ذلك في مواجهة الجريمةالمنظمة.

Résume : L’un des changements les plus marquants dans la nature de la criminalite, il y a le phenomene du crime organise qui menace L'entite de l'etat a l'interieur et a l'exterieur. Il etait donc necessaire d'introduire de nouvelles mesures pour lutter contre ce phenomene au niveau des conventions et chartes internationales, en particulier le droit national de l'etat a suivre le rythme du developpement international, ce qui a incite le législateur algérien a promulguer de nouvelles lois visant a suivre le rythme du phénomène de la criminalite organisee.parallelement, le legislateur algerien a introduit de nouvelles activites dans la loi de procedure penale, notamment la loi 07_17, qui prevoit d'etendre les fonctions et pouvoirs de la police judiciaire, tout cela pour mettre en evidence l'efficacite de cette loi face aux crime

Summary: The most prominent changes in the character of the crime actually is the organized crime. The last mentioned became a threat to the state entity both internally and externally. Therefore it was necessary to introduce new procedures to fight it in terms of international agreements and pacts, especially the national law of the state to keep pace with the international development . Which led the algerian legislator to introduce and enact new laws in an attempt of keeping up with the phenomenon of arranged crime, since the algerian legislator tend to create new performance of penal procedures law certainly 07_17 which contains the expansion of judicial police functions and authorities. All above was to show the cost-effectiveness of those procedures in facing this orgnized crime .
