الإفراج المشروط في التشريع الجزائري Title of the article Parole in the Algerian legislation

Abstract

تعد عملية إعادة إدماج و إصلاح المحبوسين من الأهداف المستجدة التي تسعى إليها المنظومة العقابية الجديدة في الجزائر و ذلك من خلال إقرار أساليب لتكييف العقوبة السالبة للحرية منها أسلوب الإفراج المشروط الذي يعد كبديل للعقوبة السالبة للحرية المنصوص عليه في الباب السادس الفصل الثالث ضمن القانون 05 - 04 المتضمن تنظيم السجون و إعادة الإدماج الإجتماعي للمحبوسين ، و قد أولى المشرع أهمية بالغة لهذا الإجراء حيث نص في مجموعة من النصوص على شروط و إجراءات جوهرية تضفي عليه طابع المشروعية لتحقيق الغرض السامي للعقوبة و هي إصلاح و تأهيل المحبوس . الكلمات المفتاحية : الإفراج ، المشروط ، الإدماج ، الإجتماعي ، المحبوسين . Abstract: The process of reintegration and reform of imprisoned persons is one of the new goals pursued by the new penal system in Algeria, through the adoption of methods to adapt the penalty depriving freedom, including the method of conditional release, which is considered as an alternative to the freedom deprivation penalty stipulated in Chapter Six, Chapter Three within Law 05-04 This includes organizing prisons and the social reintegration of prisoners, and the legislator attached great importance to this procedure, as it stipulated in a group of texts essential conditions and procedures that give it the nature of legitimacy to achieve the supreme purpose of punishment, which is reform and rehabilitation of the imprisoned
