التعاون الدولي في مكافحة الجريمة المعلوماتية

Abstract

ملخص: يعد التعاون الأمني الدولي بين الأجهزة المختصة بمكافحـة الجرائم المعلوماتية في الدول أحد أهم الوسائل التي یمكن من خلالها منع الجرائم المعلوماتية أو الحد منها، وتؤكد التحقيقات في الجرائم المعلوماتية على أهمية التعاون الأمني الدولي، حیث يستحیل على الدولة بمفردها القضاء على هذه الجرائم الدولیة العابرة للحدود، لأن جهاز الأمن لا یمكنه تعقـب المجرمين وملاحقتهم إلا في حدود الدولة التابع لها. لهذا وجب التعاون الدولي في هذا المسعى، الذي يعتبر اللبنة الأولى والركيزة الأساسية في مواجهة الجرائم المعلوماتية، نظرا لكونها غالبا ما تتم في أماكن متفرقة في العالم باستخدام تقنيات حديثة. غير أن التعاون المنشود تعترضه عدة إشكالات وعقبات، سواء على الصعيد الوطني كعدم كفاية و ملاءمة القوانين القائمة وصعوبة إثبات الجريمة المعلوماتية، أو على المستوى الدولي كقصور التشريع الدولي وتنازع الاختصاص القضائي الدولي والإشكالات الخاصة بالإنابة القضائية وتسليم المجرمين، وهو ما يستدعي بذل المزيد من الجهد لتخطي هذه العقبات.

Résumé : La coopération internationale en matière de sécurité, entre les dispositifs de police criminelle spécialisée en cybercriminalité, est considérée comme l’un des moyens les plus importants dans la neutralisation ou diminution des cybercrimes. Les investigations dans ce domaine ont confirmé la nécessité de cette coopération internationale, étant donné que les efforts individuels fournis par les états n’arriveront jamais à anéantir ces crimes transnationaux car le dispositif sécuritaire ne pourra traquer les criminels que dans les limites de l’état auquel ils appartiennent. D’où la nécessité de la coopération internationale ; considérée comme la première base principale en matière de lutte contre ces cybercrimesse produisant à travers le monde entier, en utilisant des techniques très avancées et sophistiquées. En revanche, cette coopération souvent fait face à des obstacles et problèmes, tant au niveau national, tels que : législations inadéquates et difficultés de prouver l’existence du cybercrime ; qu’au niveau international, les que : insuffisance des législations internationales, conflits des compétences juridictionnelles internationales, problèmes en matière de délégation judiciaires et l’extradition. Problèmes nécessitant de plus amples efforts pour les surpasser et les éviter définitivement.

Summary : the international security cooperation between the criminal police devices specialized in cybercriminaly ,is considered as one of the most important means to counteract and neutralize the cybercrimes . the investingations in this field have confirmed the necessity of this cooperation , considering that the individual efforts of eat state can never eradicate these transnational crimes, because the security device is able to track the criminals only within the state to which they belong .this is why the international cooperation is counted as the first main basis to fight the cybercrimes around the world using advanced techniques and methods . on both national level as inappropriateness of legislalions and the difficulty to prove the said cybercrimes, and on the international level as lack of international legislation , the international jurisdictional conflicts , the problems of judicial delegations and the extradition ; more efforts have to be provided to overcome all these obstacles and difficulties .
