Abstract: Recently, Algeria has experienced a serious phenomenon related to the leaking and disclosing of information and administrative documents issued by public authorities, which carry secrets that should not be disclosed to others due to the serious damage to the State or authority whose secrets are disclosed. This situation necessitated the intervention of the State to ensure the protection of secrets by issuing the Order 21-09 of June 8, 2021 concerning the protection of administrative information and documents. Some of its provisions were devoted to the penal protection of the confidentiality of administrative documents and information. Accordingly, this study dealt with the analysis of legal texts containing the criminal protection of the confidential information and administrative documents under this order. Finally, we concluded that the legislator had established an effective criminal protection for the confidentiality of documents and administrative information, but some of the texts are subject to legal and practical gaps that must be addressed
