Abstract

In light of the current inflow of migrants into Algeria, it is crucial to be aware of the regulations that govern foreigners. This study, titled “An Annotated Translation of Law No. 11 - 08 dated 25 June 2008, relating to conditions for foreigners' entry, stay, and movement in Algeria.” involves translating the law from Arabic into English and at the same time writing an annotation or commentary on translation. Following the empirical descriptive method, the study investigates the difficulties and problems faced during the process of translating the law as mentioned earlier. The issues are mainly related to the terminology, the semantic,and the stylistic features of the legal text. The research also includes a linguistic and stylistic analysis of the source text in terms of register, language function, and genre and a discussion of the translation strategies and justification of the chosen solutions we come up with for particular problems of translation. The study concluded that literal translation may be used for simple sentences but not for those that include technical phrases, as these latter are linked to society and legal background.

Comptetenu de l'affluxactuel de migrants enAlgérie, il est crucial de connaître la réglementation qui régit les étrangers. Cette étude, intitulée « Traductionannotée de la loi n° 11 - 08 du 25 juin 2008, relative aux conditions d'entrée, de séjour et de circulation des étrangers enAlgérie ». consiste à traduire la loi de l'arabeversl'anglais et à rédigerenmême temps une annotation ou un commentaire sur la traduction. Suivant la méthode descriptive empirique, l'étude examine les difficultés et les problèmesrencontréslors du processus de traduction de la loi, commementionnéprécédemment. Les problèmessontprincipalementliés à la terminologie, à la sémantique et aux caractéristiquesstylistiques du textejuridique. La recherche comprendégalementune analyse linguistique et stylistique du texte source entermes de registre, de fonctionlinguistique et de genre, ainsiqu'une discussion sur les stratégies de traduction et la justification des solutions choisies que nous proposons pour des problèmesparticuliers de traduction. L'étude a conclu que la traductionlittéralepeutêtreutilisée pour des phrases simples mais pas pour celles qui incluent des phrases techniques, car cesdernièressontliées à la société et au contextejuridique.

بالنظر إلى التدفق الحالي للمهاجرين إلى الجزائر،بات من الضروريمعرفة الأحكام التي تضبط وضعية الأجانب. وعليه تتضمن هذه الدراسة ترجمة القانون رقم 11-08 المؤرخ في 25 جوان 2008 والمتعلق بشروط دخول الأجانب إلى الجزائر وإقامتهم بها وتنقلهم فيهامن العربية إلى الإنجليزية والتعليق على الترجمة. حيث تبنت هذه الدراسة الأسلوب الوصفي التجريبيلتوضيح الصعوبات والمشكلات التي اعترضت عملية ترجمة القانون المذكور آنفا. وتكمن المشكلات في المقام الأول في طبيعة المصطلحات القانونية، والخصائصالدلالية والأسلوبية للنص القانوني. كما تتضمن الدراسة التحليل اللغوي والأسلوبي للنص المصدر من حيث السجل اللغوي، والوظيفة اللغوية، ونوعالنص. بالإضافة إلى تحليل الترجمة من حيث الصعوبات والاستراتيجيات المتبعة وكذا شرح القرارات والحلول التي تم اعتمادها. وخلصت الدراسة الى انه يمكن استخدام الترجمة الحرفية على مستوى الجمل البسيطة وليس مع تلك التي تحوي عبارات تقنية لأن هذه الأخيرة مرتبطة بالمجتمع والخلفية القانونية.
