Abstract

ملخص: يسعى المشرع الجزائري من أجل وضع قواعد وأطر قانونية تنظم مجال الاستثمار، وتحسين المناخ الاستثماري وتعزيز الشفافية والمساواة في المعاملة بين المستثمرين المحليين والأجانب، وهذا من أجل النهوض بهذا المجال وخلق أريحية لدى المستثمر، ومن بين أهم ما يكرسه المشرع في هذا المجال هو وضع ضمانات قانونية وقضائية مبنية على أسس وقواعد موضوعية، وتكريس مبادئ الاستثمار والتحفيزات الجبائية الممنوحة للمستثمر، وهذا ما كان من خلال آخر تعديل للقانون المتعلق بترقية الاستثمار رقم 22-18 ، والذي جاء بجملة من المبادئ والضمانات القانونية والتشريعية وتسهيلات جبائية وتحفيزات مالية للمستثمرين، وتقديم حماية للاستثمارات.

Résumé: Le législateur algérien cherche à établir des règles et des cadres juridiques régissant le domaine de l'investissement, à améliorer le climat d'investissement, à renforcer la transparence et l'égalité de traitement entre les investisseurs locaux et étrangers, dans le but de promouvoir ce domaine, de créer une atmosphère de confiance pour l'investisseur. L'une des principales préoccupations du législateur dans ce domaine est de mettre en place des garanties juridiques et judiciaires fondées sur des bases et des règles objectives, et de consacrer les principes d'investissement et les incitations fiscales accordées aux investisseurs. Cela a été réalisé grâce à la dernière modification de la loi sur la promotion de l'investissement numéro 22-18, qui comprend un ensemble de principes, de garanties juridiques et législatives, de facilités fiscales et d'incitations financières pour les investisseurs, ainsi que la protection des investissements.

Abstract: The Algerian legislature seeks to establish rules and legal frameworks governing the field of investment, improve the investment climate, and strengthen transparency and equal treatment between local and foreign investors, with the aim of promoting this field and creating a trusting environment for investors. One of the main concerns of the legislature in this field is to establish legal and judicial guarantees based on objective bases and rules, and to devote investment principles and tax incentives granted to investors. This was achieved through the latest amendment to the law on investment promotion number 22-18, which includes a set of principles, legal and legislative guarantees, tax facilities, and financial incentives for investors, as well as investment protection.
