Abstract

ملخص الدراسة: ان عقد العمل شأنه شأن باقي العقود يخضع لنظرية العقد وأساسا الى مبدأ القوة الملزمة، يلعب عقد العمل دورا هاما في تنظيم علاقة العمل التي تجمع صاحب العمل والعامل وتقيد فيه جميع شروط العمل وحقوق وواجبات طرفي عقد العمل ومن خلالها يظهر دور القضاء في حماية الحقوق و صيانة الالتزامات و هذا ما أقره المشروع في الدور الإيجابي للقضاء

Summary: The employment contract, like any other contract, is subject to contract theory, primarily the principle of binding force. The employment contract plays a crucial role in regulating the relationship between the employer and the worker, encompassing all work conditions, rights, and obligations of both parties. Through it, the role of the judiciary in safeguarding rights and upholding obligations is evident, as recognized by the project in its positive contribution to the judiciary

Résumé de l'étude : Le contrat de travail, comme tout autre contrat, est soumis à la théorie du contrat et notamment au principe de la force obligatoire. Le contrat de travail joue un rôle important dans l'organisation de la relation de travail entre l'employeur et le travailleur, en établissant toutes les conditions de travail ainsi que les droits et devoirs des parties au contrat de travail. Il met en évidence le rôle du pouvoir judiciaire dans la protection des droits et le respect des obligations, comme le prévoit le projet dans son rôle positif de la justice.
