تحقيق التوازن في عقـود نقـل التكنولوجيـا

Abstract

أردتمنخلالهذاالبحثالوقوف على تطورعقودنقلالتكنولوجياوالتيهي منالأهميةبمكانفي المجالالاقتصادي والتجاريالذييشهدهالعالمفيشتىالمجالاتوالذي يظهرجليامنخلالأحدثالابتكاراتوالاختراعاتالعلمية الفنية والتقنية في مختلفالأنشطةالاقتصادية،والتي تتميزبها وتملكها الدولالمتقدمة والصناعية،وحاجةالدولالناميةلهذاالنوعمنالتكنولوجيامناجلالنهوض بمجتمعاتها وتحقيق التنمية فيشتىالمجالات. وهذا من خلال التطرق بالدراسة للنظام القانوني لهذا العقد، بالإضافة إلىالتعرض للمحاولاتوالجهـــــودالدوليةالتيجاءتمن اجلتنظيمهذاالنوعمنالعقـــودبينالموردوالمستوردللتكنولوجيا، ومن أجل تحقيق التوازن في هاته العقود وحماية الطرف الضعيف (المتلقي) من الشروط التقييدية التي يتعرض لها من الطرف القوي (المورد)، وكذا التطرق إلى سبل ووسائل حل المنازعاتدونالمساسبالمصالح الخاصة والمشتركةلأيمنالمتعاقديــن،وهذامناجــل تحقيــقالتكاملوالتعاونالدوليينفيشتىالمجالات لاسيمافيالمجالالاقتصادي الصناعي والوصول إلى التطور التكنولوجي المنشود . Je voulais à travers ce support de recherche sur le développement de contrats de transfert de technologie, qui sont d'une importance capitale dans le domaine économique et commercial dans lequel le monde est témoin dans divers domaines, ce qui est évident à travers les dernières innovations et les inventions scientifiques, l'art et la technologie dans diverses activités économiques, qui sont caractérisés par et détenues par les pays industriels avancés, et le besoin des pays en développement pour ce type de technologie pour l'avancement de leurs sociétés et de développement dans divers domaines. Ceci est grâce à l'étude du système juridique de ce contrat adressée, en plus de l'exposition à des tentatives aux efforts internationaux qui est venu de réglementer ce type de contrat entre le fournisseur et l'importateur de la technologie, et afin de parvenir à un équilibre dans ces contrats et la protection de la partie la plus faible (récepteur) des conditions restrictives qui sont exposés à partir de fort parti (le fournisseur), ainsi que pour traiter les voies et moyens de résoudre les conflits sans préjudice à des intérêts particuliers et commun à l'un des contractants, et ce afin de parvenir à l'intégration et la coopération dans divers domaines, en particulier dans l'accès industriel et économique au développement technologique désiré. I wanted through this research stand on the development of technology transfer contracts, which are of utmost importance in the economic and trade area in which the world is witnessing in various fields, which is evident through the latest innovations and scientific inventions, art and technology in various economic activities, which are characterized by and owned by the advanced industrial countries, and the need of developing countries for this kind of technology for the advancement of their societies and development in various fields. This is through the study of the legal system of this contract addressed, in addition to the exposure to attempts to international efforts that came to regulate this type of contract between the supplier and importer of technology, and in order to achieve a balance in these contracts and the protection of the weaker party (receiver) of the restrictive conditions that are exposed from strong party (supplier), as well as to address the ways and means of resolving disputes without prejudice to special interests and common to any of the contractors, and this in order to achieve integration and cooperation in various fields, particularly in the industrial and economic access to technological development desired.
