وضع الأجانب الوافدين إلى الجزائر وفقا للقانون 08/11

Abstract

حاولنا من خلال هذه الدراسة إلقاء الضوء على وضع الأجانب الوافدين إلى الجزائر وفقا للقانون 08/11 حيث انطلاقا في هاته المذكرة مرتكزين في ذلك على مناقشة وتحليل الإشكالية وذلك من خلال تقسيم المذكرة إلى فصلين ، تطرقنا في الفصل الأول إلى القواعد المنظمة لدخول الأجانب للإقلـــيم الجزائري وخروجهم منه من منظور القانون 08/11، حيث يتضح من خلاله إن المشرع اشترط لدخول الأجانب للإقليم الجزائري مجموعة من الشروط والإجراءات القانونية ، كما يتبين إن لسلطات المختصة إن تمنع دخول إي أجنبي غير مرغوب فيه . كما يكفل القانون 08/11 للأجنبي حق الخروج من الأراضي الجزائرية، كما يحق لسلطات المختصة إن تنهي إقامة الأجنبي وذلك من خلال الإبعاد أو الطرد. إما الفصل الثاني كان معنون بالقواعد المنظمة لإقامة و تشغيل الأجانب في الجزائر من مـــنظور القانون 08/11 وبدوره قسمنه إلى مبحثين، حيث يتضح إن القانون 08/11 اشترط مجـــــموعة من الشـروط لإقامة الأجنبي بالجزائر وأورد مجموعة من الحقوق التي يتمتع بها الأجنبي خلال إقامته. كما سمح القانون 08/11 للأجنبي ممارسة نشاط أو العمل في الجزائر وهذا يتوقف على احــترام الشروط والإجراءات القانونية لتشغيل القانوني في الجزائر. وقصد محـاربة الهجرة غير الشرعية والإقامة غير النظامية والتشغيل غير الــقانوني أورد القانون 08/11 جملة من العقوبات والإجراءات للأجنبي المخالف ولكل من يساعده على ارتكابه المخالفة Nous avons essayé à travers cette étude a mis en lumière sur l'état des arrivées de l'étranger vers l'Algérie, selon la loi 11/08, où dans ces mémoire selon à la discussion et l'analyse de la problématique et que en divisant la mémoire en deux chapitres, nous avons discuté dans le premier chapitre aux règles régissant l'entrée des étrangers à la région algérienne et de sortie de celui-ci du point de vue du droit de 11/8, ce qui est clair, d'où le législateur stipule à l'entrée des étrangers à la région algérienne ensemble de conditions et de procédures judiciaires, Comme en témoigne l'état dans lequel le législateur pour entrer territoire étranger jeu algérien des conditions et des procédures judiciaires, comme on peut le voir à ce que les autorités compétentes pour prévenir l'entrée d'un étranger indésirable. 08.11 La loi garantit également le droit d'un étranger sur le territoire algérien, sont également droit aux autorités compétentes de mettre fin à l'établissement étranger, par la déportation ou d'expulsion.
