النظام القانوني لبطاقة المقيم في الجزائر

Abstract

تعتبر بطاقة المقيم سند الهويـة الذي يسمح لحاملهـا بالإقامة في الجزائر، حيث لا يمكنه استعمالها للحصول على عمل مأجور، والذي يشترط جواز أو رخصة عمل مؤقتة، وهذه البطاقة سالفة الذكر تحكمها أحكام القانون 08-11 كمبادئ عامة، وقوانين أخرى محال إليها في هذا القانون، وأيضا هناك حالات خاصة تحكمها الاتفاقيات الدولية الثنائية، التي صادقت عليها الجزائر في مجال تسهيل دخول رعايا الدولتين والإقامة والتشغيل، وبطاقة المقيم لها أهمية بالغة خاصة في التعرف على هوية الأجنبي، خاصة في الحدود، وكذلك في مجال مكافحة الهجرة غير الشرعية، الذي يظهر في الآثار المترتبة عن مخالفة أحكام الإقامة التي تؤدي إلى سحب البطاقة. La Carte de résident est le support de l'identité qui permet à son titulaire à séjourner en Algérie, où il ne peut pas être utilisé pour un emploi rémunéré, ce qui nécessite un passeport ou un permis de travail temporaire, et ceux-ci précitée régie par les dispositions de la loi 08-11 en tant que principes généraux, et d'autres lois magasins à dans cette carte de la loi, et aussi Il ya des cas spéciaux régis par des accords internationaux bilatéraux ratifiés par l'Algérie dans le domaine de la facilitation de l'entrée des ressortissants des deux pays, la résidence et l'emploi, et la carte-résident est d'une extrême importance, surtout dans l'identification identité d'étranger, en particulier dans la frontière, ainsi que dans la lutte contre l'immigration clandestine, qui apparaît dans les implications pour violation des dispositions de l'hébergement qui conduisent au retrait de la carte. The resident card identify the identity of ones owners, that permit him/her to live in Algeria, but the owner can’t use it to find a job even can’t not find a temporal work, this card has principles as well it laws 08/11 as general principles, also there are other cases mastered by international conventions that Algeria accept to simplify the entry of stingers for settling and working, finely the settlement card has a great importance, identifying the identity of the foreigner especially in the frontiers, and in filling illegal immigration witch appear in the impact of the misuse of the settlement card legally that leads to out the retrainof the card.
