dc.description.abstractUnder the application of the theory of exceptional circumstances, the legislature granted to management broad powers to cope with the circumstances which aims to protect public order and the public interest in the community; in which , management may use extraordinary means may be harmful to public freedoms, which guaranteed protection constitutions and international conventions, especially in the case of declaration of a state the siege and the state of emergency, and the exceptional case; therefore, we have tried in this research to show the most effective safeguards that contribute to the protection of individuals’ public freedoms from arbitrary administration in the case of application of the theory of exceptional circumstances statement. The most important guarantee for the protection of freedoms in this case is the responsibility of management for all of its work, and subject to judicial scrutiny, which stands on the side of the protection of these freedoms, in addition to the conditions that is imposed by the administrative management in order to apply the theory of exceptional circumstancesen_US
