Abstract: Fundamental rights is the second mechanism for the realization of the principles of human rights in the domestic legal system. The most important of these rights is the right to equality. Which he devotes all international conventions on human rights for its importance in the preservation of human dignity and the stability of political systems. So modern constitutions have made the principle of equality to ensure compliance by all the institutions and governments, even by the legal texts producers when their creation to these texts. In this context, the Algerian constitution established the Constitutional Council to ensure respect for the Constitution, through its control of constitutionality. the Council took into account in its case law the respect of the legal texts of the principle of equality, but further from this, the Constitutional Council was based on this principle in the protection of many fundamental rights against the legislature itself , hence the importance of the constitutional protection of this principle.
