الحماية الجنائية للمال العام

Abstract

يلعب المال دورا مهما في سيادة الدول، ألنه عصب الحياة و أحد أركان ودعائم العملية التنموية، والمال العام الـذي يشمل جميع المنقوالت و العقارات المملوكة للدولة أو األشخاص االعتبارية العامة التي تكون مخصصة للنفع العام أو مرفق عمومي بالفعل أو بمقتضى القانون. لـذا فإنها تتمتع بحماية قانونية تتناسب مع طبيعتها، بل إن المشرع الجزائري قد وضع هـذه الحماية في صلب الدستور أيضا وجعله واجبا على الدولة و أفراد الشعب. والحماية الجنائية للمال العام هي القواعد و األحكام القانونية التي يضمنها قانون العقوبات والقوانين واألنظمة األخرى، والتي تجرم أي فعل اعتداء يقع على المال العام، حيث يعد أي اعتداء أو إضرار بالمال العام جريمة. والحماية الجنائيـة لألموال العامة ال تقتصر على قانون العقوبات و إنما نصت قوانين أخرى على تجريم االعتداء على األموال العامة. وأكثر الجرائم التي تشكل اعتداء على المال العام، تقع من قبل الشاغلين للوظيفة، بحكم عملهم الوظيفي، وهناك بعض الجرائم تقع من غيرهم L'argent joue un rôle important dans la souveraineté des pays, parce qu'il est la base de vie et l'un des encoignures et les piliers de l’opération du développement, et le fonds public qui concerne tous les biens mobiliers et immobiliers appartenant à l'État ou des personnes morales de droit public qui ont été affectées à l'utilité public ou un établissement public déjà en place ou en vertu de la loi. Ainsi, ils bénéficient d'une protection juridique en rapport avec la nature, mais le législateur algérien a mis cette protection et également au cœur de la Constitution et en font le devoir de l'Etat et le peuple. Et la protection pénale du fonds public sont les règles et les décisions juridiques garantis par le Code pénal et d'autres lois et règlements, qui criminalisent tout acte d'agression est sur du fonds public, où est tout abus ou dommage du fonds public, est un crime. Et la protection pénale des fonds publics ne se limite pas au Code pénal et d'autres lois, mais prévu pour la criminalisation de détournement de fonds publics.
